1. AGREEMENT TO TERMS
1.1 Formation of Agreement
These Terms constitute a binding legal contract between you, an individual user or site visitor, whether personally or on behalf of an entity (“user,” “you,” or “your”) and Sky Frontier Foundation, a foundation company incorporated under the laws of the Cayman Islands (including all its affiliates and subsidiaries, collectively referred to as the “Foundation,” “we,” “us,” or “our”) concerning your use of the www.skyeco.com website (the “Website”), including all associated subdomains, and any content, functionality, and services offered on or through the Website.
1.2 Nature of the Website
The Foundation maintains and operates www.skyeco.com as a portal for independent research, analysis, and information regarding the Sky Ecosystem. The Website publishes independent analytical content including, but not limited to, quarterly and annual reports regarding the Sky Protocol, updates and analysis of Sky Ecosystem fundamentals, and estimates and outlooks based on publicly available data. The Website serves as an independent analytical resource and does not provide any interactive services, blockchain interfaces, or protocol access.
1.3 Independence Disclaimer
Sky Frontier Foundation operates independently from SkyDAO and all other Sky Ecosystem participants. While the Foundation may receive grants from various entities within the Sky Ecosystem, the Foundation does not act on any such entity’s instructions, does not represent any such entity’s interests, and makes its own independent decisions through its Board of Directors. The Foundation does not control the Sky Protocol or its DAO governance processes, does not participate in governance decisions, and has no authority to direct or bind SkyDAO’s governance decisions. The Foundation does not issue, custody, redeem, manage reserves for, or guarantee USDS or any other digital asset, and has no authority to bind the Sky Protocol or its governance. The Foundation’s governance structure and decision-making processes are entirely separate from SkyDAO governance. This Website and its content should not be attributed to SkyDAO, the Sky Protocol, or any other ecosystem participant.
1.4 Acceptance of Terms
BY ACCESSING OR USING THE WEBSITE, YOU REPRESENT AND WARRANT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. If you are accessing or using the Website on behalf of an entity, you represent and warrant that you have the authority to bind such entity to these Terms, and all references to “you” herein shall include such entity.
1.5 Additional Terms
Supplemental terms and conditions or documents that may be posted on the Website from time to time, including but not limited to our Privacy Policy available at www.skyeco.com/privacy and Cookie Policy available at www.skyeco.com/cookies-policy, are hereby expressly incorporated herein by reference and form part of these Terms.
2. ELIGIBILITY AND RESTRICTIONS
2.1 Age Requirements
The Website is intended solely for users who are at least eighteen (18) years old, the age of legal majority in their jurisdiction, or accessing the Website under the direct supervision of a parent or guardian who meets the above requirements and agrees to be bound by these Terms. By using the Website, you represent and warrant that you meet these requirements.
2.2 Capacity and Authority
You represent and warrant that:
- You have the legal capacity to enter into these Terms;
- You are not barred from using the Website under any applicable law;
- Your use of the Website will not violate any applicable law or regulation; and
- If acting on behalf of an entity, you have all necessary authority to bind such entity.
2.3 Geographic Restrictions
You may not access or use the Website if you are located in, incorporated in, or a citizen or resident of any country, state, territory, or other jurisdiction that is subject to comprehensive sanctions administered by the United States Office of Foreign Assets Control (“OFAC”), the United Nations Security Council, the European Union or European Economic Area, His Majesty’s Treasury of the United Kingdom, or any other relevant sanctions authority. You may not access or use the Website if you are listed on any sanctions list or equivalent maintained by any of the above authorities. You must immediately cease using the Website and notify us if your status changes with respect to any of these restrictions.
3. LICENSE AND RESTRICTIONS
3.1 Limited License Grant
Subject to your complete and ongoing compliance with these Terms, the Foundation grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Website solely for lawful, non-commercial purposes in accordance with these Terms.
3.2 Prohibited Uses
You agree not to, and shall not permit any third party to:
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Website;
- Remove, alter, or obscure any proprietary notices or labels on the Website;

We reserve the right to investigate any suspected violations of these Terms, suspend or terminate your access to the Website for any violation, report suspected illegal activities to law enforcement authorities, and take legal action against violators.
4. INTELLECTUAL PROPERTY
4.1 Ownership
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, reports, analyses, data, and the design, selection, and arrangement thereof) are owned by the Foundation, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.2 Trademarks
The Foundation name, Sky Frontier Foundation logo, Sky Ecosystem Insights name, and all related names, logos, product and service names, designs, and slogans are trademarks of the Foundation or its affiliates or licensors. You must not use such marks without the prior written permission of the Foundation. All other names, logos, product and service names, designs, and slogans on the Website are the trademarks of their respective owners.
5. NO INVESTMENT ADVICE; REPORTS AND PUBLICATIONS
5.1 Information Only
You agree that the information presented on or through the Website is for general informational and educational purposes only. The reports, analyses, estimates, outlooks, and other content published on the Website (“Content”) are provided solely for informational purposes and do not constitute investment, financial, tax, legal, or other professional advice.
5.2 No Recommendations
NOTHING ON THE WEBSITE CONSTITUTES: (A) A RECOMMENDATION TO BUY, SELL, OR HOLD ANY DIGITAL ASSET, TOKEN, OR SECURITY; (B) AN OFFER OR SOLICITATION OF ANY KIND; (C) A GUARANTEE OF ANY INVESTMENT RETURN OR PERFORMANCE; OR (D) AN OFFER OR SALE OF SECURITIES IN ANY JURISDICTION. The Foundation’s Board of Directors owes fiduciary duties solely to the Foundation, not to any tokenholders, protocol participants, or readers of the Website. No fiduciary, advisory, or other relationship is created between the Foundation and any reader of the Website or any participant in the Sky Ecosystem by virtue of accessing the Website or any Content.
5.4 Independent Research and Methodology
The Content is based on the Foundation’s independent analysis of publicly available information, including on-chain data, governance proposals, community discussions, and third-party market data. All estimates and outlooks reflect the Foundation’s subjective analysis and methodological judgments on which reasonable analysts may differ. Readers are encouraged to conduct their own independent analysis of publicly available data. The Foundation does not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such Content is strictly at your own risk.
5.5 Third-Party Data
Certain information in the Content may be derived from third-party sources (including publicly available blockchain and market data). The Foundation has not independently audited or verified such information and makes no representation or warranty as to its accuracy, completeness, timeliness, or reliability. The Foundation does not control the Sky Protocol or its DAO governance processes. Decentralized governance decisions and protocol outcomes are outside the Foundation’s control, and no statement on the Website or in any Content should be interpreted as a commitment by the protocol’s community or governance. The Foundation does not issue, custody, redeem, manage reserves for, or guarantee USDS or any other digital asset, and has no authority to bind the Sky Protocol or its governance.

The Foundation undertakes no obligation to update, supplement, or correct any Content, and any Content may be incomplete or become inaccurate due to subsequent events.

The Foundation or its personnel may, from time to time, hold digital assets or have interests in projects discussed in the Content. Such interests do not affect the independence of the analysis and are not a recommendation or endorsement.

9. DISCLAIMERS AND ASSUMPTION OF RISK

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDATION’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100).
9.3 Disclaimer for Reports and Publications
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOUNDATION DISCLAIMS LIABILITY FOR DIRECT OR INDIRECT LOSSES ARISING FROM THE USE OF, OR RELIANCE ON, ANY REPORT, PUBLICATION, ESTIMATE, OUTLOOK, OR OTHER CONTENT PUBLISHED ON THE WEBSITE OR BY THE FOUNDATION.
9.4 Basis of the Bargain
You acknowledge that these limitations reflect the allocation of risk between the parties, these limitations are an essential element of the basis of the bargain between the parties, the Website would not be provided without these limitations, and you have had the opportunity to secure insurance against these risks.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Foundation and all Foundation Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your violation of any applicable law or regulation; (e) any content you submit or transmit through the Website; (f) your negligence or willful misconduct; (g) any dispute between you and any third party; (h) your violation of export controls, sanctions, or embargoes or (i) your infringement or misappropriation of intellectual property or proprietary rights . We will provide you with reasonable notice of any claim subject to indemnification. Your indemnification obligations under this Section shall survive any termination of these Terms or your use of the Website.
11. RELEASE OF CLAIMS
You expressly agree that you assume all risks in connection with your use of the Website and your reliance on any Content. You further expressly waive and release the Foundation and all Foundation Parties from any and all liability, claims, causes of action, or damages arising from or in any way relating to your use of the Website or reliance on any Content. This includes, without limitation, any losses resulting from investment decisions made based on Content, reliance on estimates or outlooks, or any other use of information published on the Website.
12. DISPUTE RESOLUTION
You expressly agree that you assume all risks in connection with your use of the Website and your reliance on any Content. You further expressly waive and release the Foundation and all Foundation Parties from any and all liability, claims, causes of action, or damages arising from or in any way relating to your use of the Website or reliance on any Content. This includes, without limitation, any losses resulting from investment decisions made based on Content, reliance on estimates or outlooks, or any other use of information published on the Website.
12.1 Governing Law
These Terms and any dispute shall be governed by the laws of the Cayman Islands, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the courts of the Cayman Islands.
12.4 Informal Resolution
Before initiating any formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@skyfrontier.co. We will attempt to resolve the dispute informally for at least thirty (30) days after receiving notice.
12.3 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Website shall be resolved through binding arbitration under the Arbitration Act (As Revised) of the Cayman Islands. The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties or, failing agreement within thirty (30) days, appointed by the Grand Court of the Cayman Islands upon application by either party. The arbitration shall be conducted in English, held in George Town, Grand Cayman, Cayman Islands, governed by the laws of the Cayman Islands, and kept confidential. The arbitrator’s decision shall be final and binding, and judgment upon the award may be entered in any court having jurisdiction.
12.4 Class Action Waiver
YOU AND THE FOUNDATION AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. NEITHER PARTY SHALL PARTICIPATE IN OR SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.
12.5 Jury Trial Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AND THE FOUNDATION WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTES.
12.6 Exceptions
The following disputes are exempt from arbitration: (a) claims for injunctive relief to stop unauthorized use of the Website or protect intellectual property rights; (b) claims that may be brought in small claims court; and (c) claims that cannot be arbitrated under applicable law.
12.7 Limitation Period
Any claim arising out of or relating to these Terms or the Website must be brought within one (1) year after the cause of action arises, or such claim is permanently barred.
13. MODIFICATIONS
You expressly agree that you assume all risks in connection with your use of the Website and your reliance on any Content. You further expressly waive and release the Foundation and all Foundation Parties from any and all liability, claims, causes of action, or damages arising from or in any way relating to your use of the Website or reliance on any Content.
13.1 Modifications to Website
We may at any time, without notice or liability: (a) modify or discontinue any aspect of the Website; (b) change fees or charges (if any) for use of the Website; (c) impose limits on certain features or restrict access to parts of the Website; or (d) terminate the Website entirely. The Website may be interrupted for maintenance, upgrades, or other reasons. We are not liable for any interruption of the Website and do not guarantee continuous, uninterrupted, or secure access to the Website.
13.2 Modifications to Terms
We reserve the right to modify these Terms at any time by posting updated Terms on the Website and updating the “Last Updated” date. We will provide notice of material changes through the Website or by email where applicable. Your continued use of the Website after we post modifications and after any notice period constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Website immediately.
14. TERMINATION
You may terminate your use of the Website at any time by ceasing all use. We may suspend or terminate your access to the Website at any time for any or no reason, including immediately upon your breach of these Terms, if required by law, or if we cease offering the Website. 15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any other incorporated documents, constitute the entire agreement between you and the Foundation regarding the Website and supersede all prior agreements.
15.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 No Waiver
